What Should I Know About Tobacco Laws Before I Open My Hookah Bar?

Opening a hookah bar is coming on the rise as the trend gains popularity among young adults across the country. Before you open your hookah bar make sure you brief yourself on the tobacco laws and regulations of your state.

1.) Know how to present your business in order to comply with Clean Indoor Air Ordinances. While states can vary on their tobacco laws many of them have passed Clean Indoor Air Ordinances which limit and in some cases completely ban smoking in an indoor area. However, if you present your shop as a tobacco shop or cigar club, which do allow smoking on their premises, you can get around this. This does vary from state to state.

2.) Be sure to register with the Federal Bureau of Alcohol, Tobacco, Firearms and Explosives. All the required forms are available on their website

3.) Apply for all your permits. You’ll need a state permit to sell tobacco, a liquor license to sell liquor, and a permit from the county’s department of health to sell food. Don’t forget your business license!

4.) Check your city’s zoning laws on hookah bars. Some cities such as Garden Grove, California have put restrictions on how late hookah bars are allowed to stay open for reason of public disturbances.

5.) Safeguard your business from lawsuits. It is unlawful to sell tobacco to those under the age of 18 and you could see your shop close down really quick if a couple fake ID’s get by. Invest in a 2D barcode scanner. These scanners read the barcodes on the backs of ID’s telling you the name, if they’re an organ donor and most importantly the date of birth of the ID holder.
