11th August 2008 Bonza Is Moving

The Bonny King Bonza stories have been moved from the Gordon Highlanders webpage to their own site. This is due to the fact that Brian di Francesco, President of the Highlanders, is convinced that the cartoon character Bonny King Bonza is, in fact, himself.

As I have stated numerous times, Bonza is a purely fictional character, based on a conglomerate of people, real and fictional, and also based on old jokes. Mr di Francesco is not one of the people I have based this character on, and he does not come into the categories of cartoon character, fictional person or old joke. Therefore, I fail to see how he remains convinced that the character is based on him.

However, in recent days, Mr Francesco has threatened legal action against me if I continue to write these stories. He has also sent harassing emails to my brother, threatening legal action against my brother if this imagined harassment continues.

Most disturbing was the fact that he felt he needed to send copies of his threats of legal action, and unfounded allegations of harassment, to my brother's children, aged just 9, 10 and 12 years of age. The children have found this quite distressing.

I have been a professional writer for 11 years, and an amateur writer since high school (over 30 years). In that time, I have never bowed to pressure where my writing has been concerned, including journalism. Nor have I had anyone go to such obsessive lengths as Mr Francesco to censor my writing, and curtail freedom of speech. In this case, it even led to harassment of preteenage children, and unprecedented threats of legal, civil and criminal action.

In order to appease Mr Francesco, I have re-written the stories, and deleted all references to Gordonland, Gordonia and the like. This in no way is an admission of any liability or wrongdoing on my behalf. It is simply because I am genuinely concerned for Mr Francesco's welfare and well-being, and have, and would never, intentionally do anything that would cause him, or anyone else, distress.

King Bonza is a character I invented at high school, and was used to highlight silly stories in the newspapers, or to retell funny jokes in a different way.

I reprised this character, and the new home he lived in, purely as a bit of comic relief for the Highlanders team, to give the team a sense of "ownership" of the character. However, the character is obviously distressing to Mr Francesco, and this was never my intent.

I have now moved the revised character back to his original kingdom of 35 years ago, Bonzaland.

The Gordon Highlanders website will remain open, purely for match reports and stories relating directly to the team's performance, as such information is provided by the committee.

In a recent post, I made a gesture of goodwill to Brian de Francesco, making a public apology. This was not made because of a court order, or because I was coerced by Mr Francesco, or because I was in fear of Mr Francesco if I didn't make the apology.

It was merely a goodwill gesture to try and keep the peace, as it is clear that Mr Francesco was not willing to take the first step to maintaining harmony. His statements to various people that he somehow forced the apology are evidence of that.

I will not withdraw the apology, nor am I ashamed in any way of making it. I felt it was the adult thing to do, and I am deeply disappointed that it has not been accepted as such by Mr Francesco.

Brian di Francesco's application for AVO was dismissed in court today. Mr di Francesco was successful in being allowed to apply for an order, after being denied the opportunity to apply earlier, by misleading the court officer, and stating that I was married to him. He had been denied on earlier occasions, as the court officer could see no grounds for an application to proceed. There are apparently special provisions for married couples, so Mr di Francesco apparently decided that it would be a good idea to say he and I were married.

Mr di Francesco's statement to the court that he and I are, or were once, married is totally untrue. I am not now, nor have I ever been, married to Mr di Francesco. Nor has there ever been any mention on my part of any such union ever taking place.

It is either a lie by Mr di Francesco to allow him to make application for an apprehended violence order (which was dismissed anyway), or a delusion that Mr di Francesco is suffering.

Either way, I find it very disturbing behaviour by Mr di Francesco.

Today in court I was served with an application for an apprehended violence order (avo) by Brian di Francesco, for allegedly emailing his staff, members of the Gordon Highlanders Football Club and (unnamed) associated groups, as well as Mr di Francesco.

The emails I recall sending were copies of summonses for two civil claims , totalling about $50,000 (being for computers and other belongings wrongfully taken, unpaid wages and future earnings), and for my complaint to the anti-discrimination council of NSW for alleged discrimination against me on the grounds of my medical disability (for which I receive disability pension), plus other legal papers that needed to be served. Copies of these complaints were sent to the Highlanders committee, as they also involve the Highlanders. I do not recall having sent any other emails to Mr di Francesco or any of his staff or football club.

Mr di Francesco felt that these complaints about his alleged behaviour were threats of physical violence. This was not my intent, I sent them as a courtesy so that he would be aware of the proceedings against him.

However, I accept Mr di Francesco's assertion of fear at these emails, and, accordingly, I apologise unreservedly to Mr di Francesco and any others who received these emails and found them threatening, and specifically for any alarm Mr di Francesco experienced. I make a solemn undertaking that I will not send any further notification of future actions that may arise, or any other unsolicited emails, and will serve any future papers directly with his solicitor. This in no way is an admission of any deliberate wrongdoing on my part.

Mr di Francesco also stated in his application for AVO that he felt physically threatened by the Gordon Highlanders web page, which he feels publicly defames him. This apparently refers to the Bonny King Bonza articles, which Mr di Francesco mistakenly believes were all written by me and mistakenly believes refer to him.

This is not the case. Bonny King Bonza is a purely fictional character, and is an amalgamation of several friends in Australia and overseas, plus a little poetic licence in extending the character. They in no way refer to Mr di Francesco. The stories were written by myself and others, not solely by me.

However, I accept that Mr di Francesco may (mistakenly) think they refer to him, and may (mistakenly) think that I alone and unassisted wrote them, as he is not yet in possession of the full facts. To maintain good faith, I therefore again unreservedly apologise to Brian di Francesco for all fear and alarm these fictional stories caused him, and assure him I wish him no harm or distress. This in no way is an admission of any deliberate wrongdoing on my part.

I also sought an avo against Mr di Francesco in court today. This was based largely on the fact that Mr di Francesco had broken into my room in his hotel, and stolen my computers and other equipment. Some of this was later recovered by police, and I laid no charges, preferring to get on with my life, and proceed with recovering the unrecovered property through the courts. The court today found this was not sufficient to grant an AVO, and I accept the court's decision.

I apologise unreservedly to Mr di Francesco for any distress today's court action has caused him. I also apologise unreservedly to Barry Brown and Tanya Croker, who attended court today as witnesses for Mr di Francesco, for any distress or inconvenience it caused them. This in no way is an admission of any deliberate wrongdoing on my part.

I reiterate, my creation of Bonny King Bonza is not based, even in part, on Brian di Francesco.

However, in the interests of maintaining good harmony, I will cease writing these stories for the time being, until the court decides whether I can continue writing them freely or not.

I apologise to the readers who have told me how much they enjoyed the stories, but I feel that Mr di Francesco's welfare and wishes must come first and must be respected.
